Financial Disclosure in Michigan Family Cases
The Verified Statement (FOC 23), the Verified Financial Information Form (CC 320), and what to do when information is missing
Researched by Dan Martin, Legal Researcher · Published by Onbello Legal
Quick answer
Michigan uses two financial disclosure forms. The party asking for relief gives the Friend of the Court a Verified Statement (FOC 23) and serves a copy on the other party. In addition, unless waived in writing, each party serves a Domestic Relations Verified Financial Information Form (CC 320) within 28 days after the defendant's first responsive pleading is served.
The Verified Statement (FOC 23)
In an action involving a minor, or when child or spousal support is requested, the party seeking relief must give the Friend of the Court a verified statement with, at a minimum, identifying, financial, and health care coverage information for the parties and the children, and serve a copy on the other party (MCR 3.206(C)(1)). The SCAO form is FOC 23, Verified Statement (Rev. 6/22).
The Verified Financial Information Form (CC 320)
CC 320, Domestic Relations Verified Financial Information Form (Rev. 9/24) is the detailed verified financial disclosure required by MCR 3.206(C)(2), signed under the penalties of perjury. It covers personal, employment, and income information in every case, plus assets and debts in divorce, separate maintenance, and annulment cases. See CC 320 section by section.
- Deadline: each party serves it on the other within 28 days after the date of service of the defendant’s initial responsive pleading.
- Exceptions: it is not required if both parties waive it in writing, or if a settlement agreement, consent judgment, or other final order resolving the case has been signed by both parties when the case is filed.
- Serve, do not file: the form itself says not to file it with the court. You file a proof of service showing you served it.
- Consequences: failing to provide it may be addressed by the court or by motion under MCR 2.313, the rule on sanctions for failing to serve disclosures or provide discovery.
- Not the only discovery: the form does not prevent other discovery. In domestic relations cases the interrogatory limit is 35 (MCR 3.201(C)).
Confidentiality and safety
Information in both forms is confidential and is released only to the court, the parties, and their attorneys unless the court orders otherwise (MCR 3.206(C)(3)). For good cause, a party’s and the children’s addresses can be left off the copy served on the other party, but the party must then use electronic filing and service or give an alternative mailing address.
A victim of domestic violence, sexual assault, or stalking by another party may omit information that could reveal where the victim lives or works or where a child may be found (MCR 3.206(C)(2)). Any omitted information must be explained in the form or in a separate statement verified under MCR 1.109(D)(3)(b), filed by the form’s due date (MCR 3.206(C)(4)).
Keeping it accurate
If you learn that your CC 320 is incomplete or incorrect in a material way, you must supplement or correct it in a timely manner, unless the corrected information has already been made known to the other party during the case or in writing (MCR 3.206(C)(5)).
After a support order is entered in a Friend of the Court case, the order requires each party to report changes in income sources and other required information to the FOC within 21 days, in writing or by another method allowed under SCAO guidelines (MCL 552.603(7) and (8)).
When you think income is missing
Michigan’s formula treats income broadly and allows a court to look closely at business and corporate income, including whether losses were used as a tax strategy (2025 MCSF 2.01(C)(2)). The CC 320 asks self-employed parents for owner’s draws over the past 12 months, and asks parents who are unemployed or working part time about their last full-time job.
- Compare the CC 320 with documents you already have, such as tax returns, pay stubs, and bank statements.
- Use discovery, such as interrogatories or document requests, for what is missing.
- If a parent has reduced their earnings, the potential income rules in 2025 MCSF 2.01(G) may apply. See the child support guide.
