How do I change a custody order in New York?
Quick answer
To change a New York custody or visitation order, you file a petition to modify it, usually on General Form GF-40 in Family Court. The court system explains that an order may be changed if the court decides that things have changed and that changing the order would be best for the child. GF-40 asks you to describe the change of circumstances and how the order should be modified.

Free court program
For orders from Family Court, the court system points to a free Custody/Visitation Modification DIY Form program for this petition. If the order came from a court outside New York or a tribal court, GF-40 directs you to Form UCCJEA-9 instead.
Orders from a divorce
GF-40 works for orders made by Family Court or Supreme Court. Under Family Court Act § 652(b), Family Court may modify a Supreme Court custody order on a showing of a subsequent change of circumstances, unless the Supreme Court’s order says it may be modified only in Supreme Court.
